Constables Rachel McCrow, 29, and Matthew Arnold, 26, were among six people killed in the horror attack on a remote property west of Brisbane on December 12, 2022.
Almost three years later, the families of Constables McCrow and Arnold have lodged a claim for damages from both NSW and Queensland Police for debilitating psychological injuries.
"Our clients are confident that, but for the alleged negligence of the NSW ... and the Queensland Police Service, Constable Rachel McCrow and Constable Matthew Arnold would still be alive ... preparing to spend Christmas with their respective families," their solicitor said.
What the officers' families were going through "extends beyond ordinary grief", he added.
"Time does not heal all wounds," said Kirk Watterson of Brandon & Gullo Lawyers in a statement.
The families sat through five weeks of confronting testimony during the 2024 inquest into the shootings, with Coroner Terry Ryan's delivering his findings in November.
The officers' families had shown "inconceivable strength" in attending the inquest and found it difficult to accept the findings, Mr Watterson said.
The families believe pertinent evidence was overlooked or not fully considered by the coroner, he added.
Mr Ryan found the incident could not have been predicted, concluding "no government or other authority had information which would have indicated a risk" of the Wieambilla shootings.
Delusional family Nathaniel, Gareth and Stacey Train gunned down Constables Arnold and McCrow soon after the officers attended the property on behalf of NSW Police.
Nathaniel Train had been reported missing from his state primary school principal job in northern NSW.
The inquest heard NSW Police did not share information with their Queensland counterparts, including emails from Gareth Train that threatened violence should police enter his property.
Queensland officers would have the opportunity for a more complete risk assessment if they had these emails but it might not have made a difference, Mr Ryan found.
He also found the officers were adequately trained and equipped for the routine job they expected.
The claim being pursued by the officers' families required that the parties go to a compulsory conference, Mr Watterson said.
If a settlement could not be negotiated, court proceedings would then commence detailing the allegations of negligence and of the resulting injuries suffered by the families.
"Our clients are determined to invoke significant changes to the training, policies and procedures of the NSW Police Force and Queensland Police Service in an effort to protect the lives of police officers, now and into the future," Mr Watterson said.
"They also want to ensure that the families of those police officers never have to suffer the kind of pain and loss that they now endure."
Overall six people died in the Wieambilla shootings, including neighbour Alan Dare who was shot dead while investigating the gunfire.
The Trains were later killed in a shootout with specialist police.
